<header><h1>The Facebook trick online gambling is using to target Australians</h1><p><a rel=”author” href=”https://pursuit.unimelb.edu.au/individuals/dr-cesar-albarran-torres”>Dr César Albarrán-Torres </a> and <a rel=”author” href=”https://pursuit.unimelb.edu.au/individuals/professor-christine-parker-ebca572f-d316-454c-bfab-e125c6080dfa”>Professor Christine Parker</a></p></header><p>Gambling advertising has long been a <a href=”https://www.abc.net.au/news/2023-06-28/online-gambling-advertising-sports-broadcasts-computer-games/102531432″>contentious issue in Australia</a>, with critics and regulators regularly raising concerns about the intensity and placement of ads in the media. </p><p>Online gambling is rife among Australian adults, with an <a href=”https://parlinfo.aph.gov.au/parlInfo/download/committees/reportrep/RB000159/toc_pdf/Youwinsome,youlosemore.pdf”>estimated 44 per cent gambling on sports and racing</a> using a smartphone or computer. Picture: Getty Images</figcaption></figure><p>In fact, the COVID pandemic accelerated the growth of the online gambling market, with <a href=”https://parlinfo.aph.gov.au/parlInfo/download/committees/reportrep/RB000159/toc_pdf/Youwinsome,youlosemore.pdf”>Australian expenditure reaching $AU9.56 billion in 2022</a>. </p><p>While advertising on traditional outlets like television, radio or print are (relatively) easy to monitor and regulate – advertisers are bypassing these restrictions to reach potentially vulnerable populations using the internet and social media.</p><p>Because online advertising is hard to track and archive, and because there’s a high level of self-governance on social media platforms, advertisers can reach these online audiences – even if the law forbids them doing it. </p><figure class=”related inset-right” role=”complementary”><a class=”single” data-bound=”true” href=”https://pursuit.unimelb.edu.au/articles/our-love-of-sport-is-now-a-gateway-to-gambling”><img alt=”” itemprop=”image” src=”https://res-3.cloudinary.com/the-university-of-melbourne/image/fetch/s–3a4K0bh2–/c_fill,f_jpg,q_70,w_435/https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–APKqf9CK–/c_fill%2Cf_auto%2Ch_630%2Cq_75%2Cw_1200/v1/pursuit-uploads/96e/384/1f9/96e3841f92c2852fa0c980e39873dfaae00aa27fd00c92e22f26dc1b4989.jpg” /><h3>Our love of sport is now a gateway to gambling</h3><div class=”readmore”>Read more</div></a></figure><p>Our <a href=”https://www.tandfonline.com/doi/full/10.1080/16066359.2023.2269852?casa_token=6-Y5jsso83cAAAAA%3AB-hcsfovC5VH0xqBkysND5u-bTRDiExKmvci3ZK3-xoV65UISKez8kuHD_vq03CdgBON2Cwp2BWqkw”>new research</a> published with colleagues at the <a href=”https://www.admscentre.org.au/ad-observatory-project/”>ARC Centre of Excellence for Automated Decision Making and Society</a> in <a href=”https://www.tandfonline.com/journals/iart20″><em>Addiction Research & Theory</em></a> has uncovered gambling advertising to Australians by BitStarz.</p><p>This is an issue because BitStarz is an online offshore casino registered in the Dutch Caribbean Island of Curaçao, that cannot legally <a href=”https://www.acma.gov.au/about-interactive-gambling-act”>operate</a> or <a href=”https://www.acma.gov.au/misleading-or-socially-irresponsible-gambling-ads”>advertise</a> in Australia. Picture: Supplied</figcaption></figure><p>The ‘<a href=”https://parlinfo.aph.gov.au/parlInfo/download/committees/reportrep/RB000159/toc_pdf/Youwinsome,youlosemore.pdf”><em>You win some, you lose more</em></a><em>’</em> report offers 31 recommendations to lessen online gambling harm. Among these, the committee led by Labor MP Peta Murphy proposes a “phased, comprehensive ban on all gambling advertising on all media – broadcast and online, that leaves no room for circumvention”. </p><p>The proposal has prompted lobbyists from gambling companies, broadcasters, sporting codes and tech companies <a href=”https://www.theguardian.com/australia-news/2023/dec/20/lobbyists-lining-up-to-put-their-case-to-minister-over-australia-wide-ban-on-gambling-ads”>to request meetings with the communications minister, Michelle Rowland, to argue against the ban</a>.</p><p>Our research finds that when it comes to social media advertising there may indeed be “room for circumvention”. </p><figure class=”related inset-right” role=”complementary”><a class=”single” data-bound=”true” href=”https://pursuit.unimelb.edu.au/podcasts/does-australia-have-a-gambling-problem”><img alt=”” itemprop=”image” src=”https://res-1.cloudinary.com/the-university-of-melbourne/image/fetch/s–Nb56CPCH–/c_fill,f_jpg,q_70,w_435/https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–F9iTFcZJ–/c_fill%2Cf_auto%2Ch_630%2Cq_75%2Cw_1200/v1/pursuit-uploads/81c/565/015/81c565015c147fa50b8d33853dff41b35ec511d8053c5e7bf3cf855a381c.jpg” /><h3>Does Australia have a gambling problem?</h3><div class=”readmore”>Read more</div></a></figure><p>What makes our case study particularly timely is that it reveals a hidden economy of gambling ads that often fall under the radar of regulators. </p><p>Online casinos like BitStarz operate overseas with servers located in international jurisdictions that do not fall under Australian law. </p><p>Rather than advertising in online newspapers or on broadcast media (many Australians are used to seeing big gambling companies like Sportsbet or TAB on their TVs), these online casinos are promoted almost exclusively on social media – using targeted, personalised ads that are only seen by individual users and only in particular sessions. </p><p>The <a href=”https://www.admscentre.org.au/adobservatory/”>Australian Ad Observatory</a>, which researches the challenges associated with monitoring online advertising and uncovering targeted ads, gives us an insight into how casinos like BitStarz target Australians.</p><figure class=”full-width”><img alt=”” itemprop=”image” sizes=”(min-width: 1300px) 892px, (min-width: 1099px) 860px, (min-width: 769px) 700px, 100vw” src=”https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–M9TICJdC–/c_limit,f_auto,q_75,w_892/v1/pursuit-uploads/1fd/4b3/3d9/1fd4b33d94a030bdb13d610a1434517d7c8af2dc944dce8d19c29f42b60f.jpg” srcset=”https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–sJNiOMQM–/c_limit,f_auto,q_75,w_446/v1/pursuit-uploads/1fd/4b3/3d9/1fd4b33d94a030bdb13d610a1434517d7c8af2dc944dce8d19c29f42b60f.jpg 446w, https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–n8YQ8GF4–/c_limit,f_auto,q_75,w_669/v1/pursuit-uploads/1fd/4b3/3d9/1fd4b33d94a030bdb13d610a1434517d7c8af2dc944dce8d19c29f42b60f.jpg 669w, https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–M9TICJdC–/c_limit,f_auto,q_75,w_892/v1/pursuit-uploads/1fd/4b3/3d9/1fd4b33d94a030bdb13d610a1434517d7c8af2dc944dce8d19c29f42b60f.jpg 843w, https://res-2.cloudinary.com/the-university-of-melbourne/image/upload/s–MkeaJwxS–/c_limit,f_auto,q_75,w_1784/v1/pursuit-uploads/1fd/4b3/3d9/1fd4b33d94a030bdb13d610a1434517d7c8af2dc944dce8d19c29f42b60f.jpg 843w” /><figcaption>A pixellated image of the Facebook advertisements featuring an Australian flag. Picture: Supplied</figcaption></figure><p>It also highlights how monitoring and enforcement of a ban on programmatic and personalised advertising would be borderline unfeasible without the collaboration of global social media platforms. </p><p>According to the <a href=”https://www.acma.gov.au/”>Australian Communications and Media Authority </a>(ACMA), the wording of the Australian law prohibiting the advertising of online casinos “in Australia” <a href=”https://www.abc.net.au/news/2023-03-21/illegal-online-gambling-facebook-meta-casino/102118408″>potentially limits</a> the enforcement of the law against these global social media platforms. </p><p>This means that ACMA has no power to ask platforms like Facebook to block these advertisements, even though the ads themselves would otherwise be <a href=”https://www.acma.gov.au/misleading-or-socially-irresponsible-gambling-ads”>considered illegal in Australia</a> and BitStarz’s own websites have been <a href=”https://www.acma.gov.au/blocked-gambling-websites”>blocked by ACMA</a>. </p><figure class=”related inset-right” role=”complementary”><a class=”single” data-bound=”true” href=”https://pursuit.unimelb.edu.au/articles/we-need-to-keep-big-tech-in-check”><img alt=”” itemprop=”image” src=”https://res-2.cloudinary.com/the-university-of-melbourne/image/fetch/s–VDZE-PDg–/c_fill,f_jpg,q_70,w_435/https://res-1.cloudinary.com/the-university-of-melbourne/image/upload/s—l8U_V2b–/c_fill%2Cf_auto%2Ch_630%2Cq_75%2Cw_1200/v1/pursuit-uploads/d24/30c/a68/d2430ca6812f1a77da95fca4a550d2dbb4527b472e97cf5d2297054527d0.jpg” /><h3>We need to keep Big Tech in check</h3><div class=”readmore”>Read more</div></a></figure><p>Facebook, and some other platforms, do have their own <a href=”https://www.facebook.com/business/help/345214789920228?id=434838534925385″>internal policies that prohibit online casinos</a> from targeting advertising in jurisdictions where it is illegal, like Australia. </p><p>But as our research shows, these internal policies and procedures do not always work, despite the enormous information and resources social media platforms have at their disposal. </p><p>However, platforms like Facebook can and should do more to curb the presence of potentially harmful gambling ads and be transparent about how they do so. </p><p>Importantly, we need reforms to Australian law to close the loophole that makes platforms unaccountable for illegal advertising online. Picture: Supplied</figcaption></figure><p>Platforms that do not expeditiously remove illegal ads, once put on notice, should be <a href=”https://pursuit.unimelb.edu.au/articles/accc-vs-big-tech-round-10-and-counting”>held liable</a> and be required to <a href=”https://fare.org.au/wp-content/uploads/Transparency-Report.pdf”>make all ads available</a> in an easily searchable public archive. </p><p>Only by ensuring accountability and transparency from social media platforms can we hope to give Australian regulators the power prevent the harms of online gambling.</p><p> <em>This research is a result of the </em><a href=”https://www.admscentre.org.au/ad-observatory-project/”><em>Australian Ad Observatory</em><em> Project</em></a>,<em> part of the </em><a href=”https://www.admscentre.org.au/”><em>ARC Centre of Excellence for Automated Decision-Making and Society (ADM+S)</em></a><em> which is a collaboration between researchers at the University of Melbourne, Swinburne University, Monash University, QUT and industry partners including the ABC, Choice and the Consumer Policy Research Centre </em><em>(CE200100005).</em><br /></p><p><em>The project encourages citizen scientists to contribute to the research by <a href=”https://www.admscentre.org.au/adobservatory/”>‘d</a></em><em><a href=”https://www.admscentre.org.au/adobservatory/”>onating’ their Facebook advertisements</a></em><em>, which can be done by installing a plugin on their computers. To date, more than 1900 participants have donated more than 328,000 ads, resulting in over 737,000 observations.
