Prosecutors missed speedy trial deadline for filing charges

A judge granted a motion this week to dismiss a tampering with records charge against an Iowa State football player accused in the sports betting investigation.

Story County prosecutors asked a judge to dismiss the misdemeanor charge against DeShawn Hanika, last season’s top scoring tight end, after they missed a deadline. A judge granted the motion because of Hanika’s right to a speedy indictment, as required by Iowa law. Prosecutors had 45 days to file an indictment by a Sept. 24 deadline, but it wasn’t filed until Sept. 28. Hanika will faces no further legal action.

Hanika’s lawyers asked for the dismissal, which prosecutors agreed, according to court documents.

Hanika, who hasn’t played this season but remains on the roster, was accused of placing 288 mobile/online wagers, including 70 on Iowa State basketball games.

The tight end was among 17 athletes and other individuals who were charged in an Iowa Division of Criminal Investigation case stemming from illegal sports betting at the University of Iowa and ISU. So far, 10 of them have pleaded to a lesser charge of underage gambling.

Most were accused of underage gambling and using accounts on mobile sports betting apps under a different name to conceal their identity.
